Andrea Carter Photography has created this Privacy Policy (“Policy”) in order to demonstrate our firm commitment to the privacy of your personal information. The following discloses our information gathering and dissemination practices for this website (the “Site”).

This Policy tells you, among other things, what information we gather from you through our Site, how we may use or disclose that information, and our efforts to protect it.

  1. Notice of Information Collected and Disclosed

Andrea Carter Photography may collect personal information when you visit the Site and this information may be collected in a variety of ways.  In connection with your use of our Site we may collect the following information:

  • The domain name, but not the e-mail address of visitors to our Site.
  • The e-mail addresses of users who communicate with us via the Site or via e-mail.
  • Aggregate information on what pages on our Site users access or visit.
  • Information volunteered by the user, such as information provided if you request information regarding or purchase Andrea Carter Photography products or services through the Site which may include name, physical address, billing address, email, phone, and other personal information.

Andrea Carter Photography may occasionally ask customers to complete surveys and provide opinions about interests, needs, and viewpoints.  These surveys help Andrea Carter Photography provide better services and products to meet our customer’s needs.  When customers contact the Andrea Carter Photography customer service department it may be necessary to obtain personal information for record keeping and follow-up.

Primarily, Andrea Carter Photography uses the information our customers provide to improve our products or services and to respond to your inquiries or other marketing purposes. For example, we may send marketing or promotional materials related to new products or services we offering or we may need to contact a customer in response to your inquiries.

As we develop our business, we may buy or sell assets and, depending on the transaction, your personally identifiable information may be one of the transferred assets. In the event that we are acquired by another company, your personal information may be part of the assets transferred to the acquiring party.  Similarly, if Andrea Carter Photography should ever file for bankruptcy or merge with or be acquired by another company, we may sell the information you provide to us to a third party or share your personal information with any entity resulting from such transaction.

We may use your e-mail address to contact you directly regarding services, products or information that we believe might interest you. Only Andrea Carter Photography (or agents working on behalf of Andrea Carter Photography and under confidentiality agreements) will send you these direct mailings. If you do not want to receive such mailings, simply tell us though one of the means for contacting us listed in our Terms of Use Agreement. At any time you can easily opt-out of receiving further information from Andrea Carter Photography by contacting us and requesting your name be removed from our lists.  Of course, if you have an ongoing services agreement with Andrea Carter Photography, we may be required to contact you in regards to that relationship.

You authorize us to disclose any information about you to law enforcement or other government officials as we, in our sole discretion, believe necessary or appropriate, in connection with an investigation of fraud, intellectual property infringements, or other illegal activity.

You may, of course, decline to submit personally identifiable information through the Site, in which case Andrea Carter Photography may not be able to provide certain services to you.

We will not sell, share, or rent this information to others in ways different from what is disclosed in this statement.

  1. Right to File a Complaint

If you believe your privacy has been compromised by any member of our staff, you may ask to speak with the chief privacy officer to file a formal complaint or contact us through our contact page.

This website takes every reasonable precaution to protect our users’ information.  When you submit sensitive information via the Site, your information is protected both online and off-line.

It should be noted that e-mails and other information you send to us, except that which you send us on a secure page, are not encrypted and such transmissions cannot be considered a secure means of transmitting sensitive information.  Andrea Carter Photography will never ask you to submit your financial data, such as your credit card account numbers, via e-mail.  IF YOU RECEIVE AN EMAIL REQUESTING THAT YOU FORWARD INFORMATION OF THIS NATURE BY EMAIL, PLEASE CONTACT US DIRECTLY AT 915.479.1561.  DO NOT REPLY DIRECTLY TO THE EMAIL.  You should be aware of the limitations of security, authentication, encryption, and privacy measures used in connection with the Internet and that any information you transmit through the Site may be damaged, corrupted, “sniffed” and/or accessed by another person without your permission.

Regardless of the precautions taken by you or by us, “perfect security” does not exist on the Internet.  We cannot ensure or warrant the ultimate security of any information you transmit.

The Site may contain links to other sites. Please be aware that Andrea Carter Photography is not responsible for content or the privacy practices of such other sites.  We encourage our users to be aware when they leave our Site and recommend that they read the privacy statements of each and every website they visit.  This Policy applies solely to information collected by this Site.

  1. Age Restrictions; Children’s Privacy

This Site is not directed at children under the age of 18 and does not knowingly collect personal information from children under the age of 18.  If Andrea Carter Photography obtains actual knowledge that it has obtained personal information about a child under the age of 18, that information is immediately and permanently deleted from our records.

Under California Civil Code Section 1798.83, if you are a California resident and Andrea Carter Photography has an established business relationship with you, you have the right to request information from Andrea Carter Photography, free of charge, regarding the manner in which Andrea Carter Photography shares certain categories of your personal information with third parties (whether collected online or offline), for the third parties’ direct marketing purposes.  California law provides that you have the right to submit a request to Andrea Carter Photography at its designated address and receive the following information: 1) the categories of information Andrea Carter Photography disclosed to third parties for the third parties’ direct marketing purposes during the preceding calendar year; 2) the names and addresses of third parties that received such information; and 3) if the nature of a third party’s business cannot be reasonably determined from the third party’s name, examples of the products or services marketed, subject to certain exceptions. Further, Andrea Carter Photography does not respond to “do not track” (DNT) signals.

Finally, Andrea Carter Photography does not authorize third parties to collect your personal information when you use the Site, except as expressly stated in this Policy.  To the fullest extent permitted by law, Andrea Carter Photography is not responsible for, and you hereby release Andrea Carter Photography from any liability which may arise from, such third parties’ unauthorized collection of your personal information.
